Welcome to DayOne. Day one Technologies Limited (“we” or “DayOne”) is a company incorporated in Hong Kong.
By visiting our website www.dayone.date (our “Site”), or using DayOne Dating App (our “App”), you agree to be bound by these Terms and Conditions (these “Terms”) and accept our Privacy Policy.
We may update our Terms, or product and service, from time to time. This could be due to the changes in our business or external factors. The latest version of Terms will be available on our Site and App. We will notify you via email or App if there are updates materially changing your rights or obligations. By continuing to use our App or other services after Terms updates, you agree to the most updated Terms.
1. ELIGIBILITY
To create an account on DayOne, you must be at least 18 years old. By using DayOne, you confirm that you are legally allowed to use the app and will follow all relevant laws and regulations, including privacy, intellectual property, and anti-spam laws. You also confirm that you have not been convicted of a violent crime or sex crime and are not required to register as a sex offender. You must accept all of DayOne Terms. If you no longer meet these requirements, your access to the Service will be revoked and you must delete your account.
We reserve the right to suspend or terminate any account or its access to App features at our sole discretion to enforce these Terms, at any time without liability or the need of prior notice.
2. CHANGE OF SERVICE AND TERMINATION
We may change product features from time to time or remove some features without prior notice. We may terminate the App or all services entirely, in which case we will notify you using reasonable methods (unless we are unable to do so due to legal or security reasons).
If you need to terminate your DayOne account, you can delete your account by following the instructions in “Setting” on the App when you are logged in.
We may terminate your account at our sole discretion to enforce these Terms, at any time without liability or the need of prior notice.
3. SAFETY
While members’ safety is our top priority and we promote positive member interactions, we are not responsible for the behavior of any member on or off the App.
You agree to treat other users and our employees with respect, and you agree to take full responsibility for your safety and actions while using the App.
We do not conduct criminal background checks on our members and make no guarantees about their conduct. Please be cautious when interacting with other members and take care of your personal and financial safety. Do not share sensitive personal information, such as address, with other members through any platforms. Do not share your financial information or transfer money to other members through any platforms.
4. PRIVACY
We care about protecting your privacy. About how DayOne collects, stores, processes, uses, and shares personal data, please refer to our Privacy Policy. By visiting our Site or using our App, you accept and consent to our Privacy Policy.
5. CONTENT
You agree not to post, send, or share any content that could be considered offensive, threatening, or harassing to others. This includes content that is obscene, pornographic, violent, or promotes illegal activity. You also agree not to post anything that is abusive, or promotes racism, sexism, hatred, or bigotry.
You agree not to send spam or transmit any malicious code that could damage or disrupt any software or hardware.
You agree not to post content that infringes on third party’s rights.
You agree not to impersonate another person or show information of another person without consent.
You agree not to post content related to commercial activities.
You do not have rights in relation to other members’ content. You may only use other members’ content for the purpose of interacting with them on the App.
We are not obligated to store your content, so make sure to keep a copy if you need it.
We do not pre-screen content posted or shared by members. However, we reserve the right to review and remove any inappropriate content and take further actions, such as termination, to the accounts posted inappropriate content at our sole discretion without liability or prior notice. We do no tolerate objectionable content or abusive users.
6. HOW TO USE OUR APP
DayOne App is a mobile application that allows members to discover other members online and potentially to meet offline for friendly and lawful interactions. We grant you a non-transferable license to use our App. This license is automatically revoked if you exceed or differ from the scope of App usage permitted by these Terms.
You agree to comply with laws and regulations, agree to our Terms, and act responsibly and kindly to other members.
You agree to not act in unlawful and inappropriate manner, including but not limited to being discriminatory, stalking or harassing others, bullying, or running scams.
You agree not to use DayOne services for commercial purposes, modify DayOne products, use bot or crawler on our App or Site, upload viruses, or harm DayOne’s interest or the members or our employees in any way.
DayOne may investigate and take reasonable measures, including legal actions, in response to unauthorized uses of our products or services.
7. PAYMENT AND PURCHASES
DayOne may offer products or services for purchases on the App. We reserve the right to set and change prices at our sole discretion any time, and the prices may be different for different markets and users according to the local cost, business, and regulation situation.
If you purchase auto-renewal services or periodic subscriptions, you will continue to be billed automatically for the services or subscriptions until you cancel. Your payment information will be stored. You may cancel your subscription via profile setting on App.
We do not refund any purchases.
8. INTELLECTUAL PROPERTY RIGHT AND COPYRIGHT
We are the owner of all intellectual property rights such as patents, trademarks, logos, net domain names, ethical rights, data, supply codes, software, specifications, know-how, processes and business strategies (whether or not registered or unregistered) in and about the Site and App. All such rights are reserved. Nothing in these Terms or our services grants you any license or right to use our intellectual properties except as expressly stated in these Terms. You cannot use, copy, modify, publish, transmit, sell, excerpt, reverse design, reproduce, reformat or distribute any of the intellectual properties and intellectual property rights that belong to us in and about the services without our express written consent in each instance.
If you believe that your work has been copied and posted on the App in a way that constitutes copyright infringement, please submit a takedown request by sending an email to admin@dayone.date.
9. DISCLAIMER
The app and site, along with our content and member content are provided to you without any guarantees or promises. This includes any implied warranties such as fitness for a particular purpose or non-infringement. We can’t guarantee that you will find compatible matches or offline dates. Any advice or information we give you doesn’t create any additional warranties.
We also can not promise that the app or site will always work without error or that all the information provided is correct. You use the App and Site at your own risk and are responsible for your interactions with other members. We are not responsible for the behavior of our members and we do not conduct criminal background checks on members.
10. THIRD PARTY SERVICES
The service may include ads and promotions from third parties, as well as links to other websites. DayOne is not responsible for the availability and accuracy of these external sites. If you decide to interact with these third parties, their own terms will apply to your relationship with them.
11. LIMITATION OF LIABILITY
We (including our owner and employees) will not be responsible for any damages you might experience from using the app or site. This includes things like lost data, income or profits, damage to property or claims from third parties.
We are not responsible for any negative experiences you might encounter interacting with other members on or off the App.
You agree not to make any claims against us because of your use of the app or site.
If a jurisdiction does not allow this term on limitation of liability and its court decides that we can not enforce this limitation on liability, our total liability will not be more than the amount you have paid to our services.
If you do not agree to the limitation of DayOne’s liability, you should not use our services (and you should delete your account, if applicable).
12. DISPUTE RESOLUTION
Before starting arbitration, you and DayOne agree to negotiate informally and try to resolve the dispute, brought by you or DayOne, for at least 30 days. Such informal negotiation starts when one party gives written notice to another party.
Any dispute should be referred to and resolved in Hong Kong using Hong Kong laws. You and DayOne agree that any arbitration shall be limited to the dispute between you and DayOne individually. An arbitration shall not be joined with other proceedings or conducted on a class-action basis, and there is no right or authority for any dispute to be brought in on behalf of the general public or any other persons.
By using our services, you agree to the above arbitration terms. By doing so, you give up your right to go to court (except for the Hong Kong Small Claims Tribunal) or participate in a class action.
These terms on dispute resolution will continue to apply even after your relationship with DayOne ends.
13. GOVERNING LAW AND FORUM
The services are run from Hong Kong. These Terms and any issues related to our business will be governed by the laws of Hong Kong. You agree that any legal disputes will be handled exclusively by the courts in Hong Kong.
14. INDEMNITY
You are responsible for things you do and post on our App. This means that if someone makes a claim against us because of something you did, you agree to protect us (including our employees) from any damages or costs that result.
We have the right to handle any claims against us however we see fit, without getting your permission first. If we ask for your help in defending against a claim, you agree to cooperate with us.

We cannot handle complaints on behalf of third-party services. Please visit their official website for their complaints procedure.
